Our Pregnancy Scanning Services Terms & Conditions

This contract is between (1) Miracle View Ltd, Company Reg. No. 13975971; (“we”, “us”, “our”) and (2) You, the customer (“you”, “your”), and shall be governed by the following terms and conditions of sale (“Conditions”) for our services, none of which affect your statutory rights:

  1. Service Provided: We provide self-elective, non-diagnostic fetal imaging ultrasound scans of your baby.  Your scan will be completed by a fully registered midwife sonographer and sonographers.  With your consent, we will carry out a fetal ultrasound scan of your baby.Information derived from the scan will be provided in a report issued to you after your scan. Gender scans can only be performed from 15 weeks or later. If we determine that your baby is measuring less than 15 weeks gestation, a further chargeable scan would have to be booked at a later date if you wished. Gender confirmation can never be confirmed 100% accuracy. Miracle View has chosen as a responsible provider to follow guidelines set out by the British Medical Ultrasound Society. Each session will not extend above 30 minutes. We also keep all our machines output as low as reasonably achievable.
  2. Age: By agreeing to these terms and conditions you are aged 18 or over. We do not provide any fetal obstetric ultrasound imaging services to anyone under the age of 18. If requested by us, you shall agree to provide photo ID with proof of age. The only accepted photo ID proof shall be in the form of an official government issued passport, national identity card or driving licence. Refusal on your part shall cause cancellation of the scan appointment.
  3. Medical History: You understand and accept that we do not have access to your medical history and therefore cannot provide medical advice relating to any diagnosis or advise you on any diagnostic results. We do not perform anatomy or anomaly scans. We strongly recommend that you access all antenatal services made available to you by the NHS.  Our scans do not substitute your NHS scans in any way. You understand that the scan service we provide is often completed at a gestation different to your NHS scans. It is imperative that you access all antenatal services made available to you by the NHS as the identification of abnormalities is one of their primary aims and intent. It is important to note that your scan with us is a social scan only and that finding anomalies is not the primary purpose. If an anomaly is later found that was not spotted during your scan with us, you agree that we cannot be held responsible.
  4. NHS Referrals: Please note with our scan services we will not routinely be looking for an abnormality but in the event of any matter of concern being detected which may be outside of the scope of the performed scan; including but not limited to the growth of your baby or possible anomaly, this will be brought to your attention during the scan session and you will be encouraged to refer yourself to your local NHS care provider for further investigation.  If we feel the situation merits it, we will provide a referral to your local NHS care provider. Referrals to NHS will only be provided when we believe there is justified concern. We would encourage you to share the report we provide you with your NHS care provider. It is your responsibility to ensure that you then consult with your NHS care provider.
  5. Consent: Your signed consent and agreement to our terms and conditions shall be provided when booking your appointment online. Your signed consent and a medical questionnaire will also need to be completed upon arrival at your appointment. We recommend all customers to attend ten minutes prior to their allocated appointment.
  6.  On safety grounds we shall not perform any of our scan services if any of the following exclusion criteria are identified on the Consent Form or suspected to be the case in our operator’s professional opinion: The consent form is incomplete. -/- If the staff member performing the scan has concerns relating to whether the client lacks capacity to consent. -/- If the client is unable to provide adequate written and verbal consent and/or in the instance of no prior notice being given by the client to ensure adequate informed consent with provision of interpretation services or other reasonable client support or assistance needs required. -/- If the client is suspected to be under the influence of drugs/alcohol. -/- If the client does not recognise that the scan is solely for souvenir purposes and not for any diagnostic reason. -/- If the client provides information that implies they are less than 7 weeks of pregnancy. -/- If the client has had a scan within the last 14 days. -/- Known multiple pregnancy of 3 or more. -/- Previously identified suspected complications relating to multiple pregnancy, notably Twin to twin transfusion, Twin Anaemia Polycythaemia Sequence or Selective IUGR, Conjoined twins. -/- Known anhydramnios/confirmed Rupture of Membranes. -/- Bleeding or loss per vaginum, abdominal pain and/or other symptoms suspicious of ectopic pregnancy including diarrhoea, shoulder tip pain, pain in passing urine or opening bowels reported in the last 48 hours. -/- Diarrhoea or vomiting exclusive of mild morning sickness within the last 72 hours. -/- The client or any of their attending party reports any Covid 19 symptoms, has a high temperature or reports they have tested positive for Covid 19 within the last 5 days. -/- Any other contraindications or health concerns that may have been documented on the Consent Form or divulged verbally, or be suspected of in the operator’s professional opinion.
  7. What we cannot guarantee: We undertake to provide you with the best images possible, but you understand that your baby’s position during the scan is outside our control. Please note the quality of images can vary from person to person for a range of different factors, including but not limited to: baby position, an individual’s own physical condition; body mass index, etc.  We will try our best to achieve optimal images for you however if you are unhappy with the images provided, please notify us during the appointment. We will use reasonable efforts to ensure that your appointment will run on time. In relation to gender scans, we cannot guarantee the accuracy of the gender identification. We will undertake to do our best to identify the sex of your baby. We accept no liability for any incorrect indication of your baby’s gender. Our operator’s professional opinion as to the suitability of the imagery obtained is final. Where applicable, if in our operator’s professional opinion, your baby’s position at the time of the scan prevents either gender determination or the production of relevant suitable 3D/4D souvenir imagery, you may be offered one complimentary rescan on an alternative date. Suitable souvenir 3D/4D imagery is defined as varying unobstructed facial profiles, not limited to face on, combined with imagery of hands and feet where achievable. Images can vary greatly with each pregnancy as such we will not warrant the replication of any previous scan imagery the client may wish to make comparison to. In the event we determine a rescan is required this decision will be made at the earliest opportunity and the remaining appointment time will be forgone. On the extremely rare occasion we are unable to obtain that which is required after your complimentary rescan, we will provide a professional opinion as to whether the desired result would be achievable through further scanning, however any further scan would be chargeable. In the event a complimentary rescan is offered, full payment for the original appointment will be required before any rescan appointment is confirmed. If we are unable to obtain that which is required at a rescan appointment, not withstanding circumstances beyond our control, no refund will be made in relation to any unused scan time, the lack of imagery achieved or failure to confirm gender. If you choose not to elect for a complimentary rescan, or if in our professional opinion a rescan will not achieve that which is required, the cost of any relevant souvenirs already purchased from us in advance as defined in the published price list will be refunded, minus the non-refundable deposit.
  8. Our prices will be set out in our price list. We accept payment by cash, and certain debit or credit cards. The price for the scan service package will be the price stipulated at the date of the confirmed appointment. From time to time special price discounts may be offered, only one such discount shall be applied per purchase. Due to the extra time and effort involved, an additional fee supplement of £25 per scan will be added where multiple fetuses are involved; for twins, etc. Scan services are exempt from VAT as defined under HMRC VAT Notice 701/57 Paragraph 2.1.
  9. We reserve the right to modify or improve our services and Conditions without prior notice.
  10. Ownership: Other than the content you own (any material you choose to agree for us to display on this website), under these Conditions we own all the intellectual property rights and materials contained in this Website. You are granted limited license only for purposes of viewing the material contained on this Website. We retain copyright of any images and videos that we take during the appointment. We reserve the right to reuse this material for our own purposes, and by agreeing to these Terms and Conditions you are providing your consent for us to continue to do so. Ownership of the report shall belong to you once we receive payment in full for the services. You are specifically restricted from all of the following: publishing any Website material in any other media; selling, sublicensing and/or otherwise commercializing any Website material; using this Website in any way that is or may be damaging or cause harm to this Website or to any person or business entity; using this Website contrary to applicable laws and regulations; engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website. Your content must be your own and must not be invading any third-party’s rights.
  11. Bookings: A confirmed appointment is a booking for which a deposit has been paid. Bookings can be online or in person during an appointment.  A non-refundable deposit is required to secure your booking.  This deposit shall be paid with debit/credit card at the time of booking. The remainder of the price for the scanning service package as well as any additional souvenirs purchased can be paid with debit/credit card or cash. By making your booking, you agree in full, to our terms and conditions. Balance payments shall be made in advance of a scan service commencing during the scheduled appointment as defined within the confirmed appointment email. Failure to settle outstanding payments within defined time frame will result in automatic cancellation of a scheduled appointment.
  12. Scan bookings are allotted a specific time slot. Whilst every effort is made to ensure the scan is carried out at the allocated time, appointment times cannot be guaranteed. Scanning time will last from 15 minutes to no longer than 25 minutes, depending upon the scan service package booked. Please arrive at least ten minutes before your appointment to complete paper work. If you are running late please contact us. Your appointment will always end as normal at the allocated time, meaning you will lose precious scanning time if you are late. If you are running too late then your appointment will be cancelled and you will be notified.
  13. Cancellation and Amendment: You can always end the contract for the supply of services before you have received the services, but you may not be entitled to a refund if you cancel or if we have already carried out the services. If we agree with you that the souvenir you purchased is faulty you may be entitled to a refund. See the “Summary of your legal rights” paragraph for more information.
  14. Right to make changes. If you wish to make a change to the services or souvenir you have ordered, please contact us, giving at least 48-hours’ notice. We will let you know whether the change is possible or not.
  15. Cancellation of the services by you. Should you wish to cancel or amend your appointment the following terms apply:-
    a) Cancellation of a confirmed appointment up to 48 hours prior to scheduled appointment will be subject to a cancellation fee of £30 being the value of the deposit paid. Full balance will be required at the time of scan appointment, for package deals full amount will be required at the time of the first scan appointment.
    b) Amendments to a confirmed appointment up to 48 hours prior to scheduled appointment will not be subject to any amendment fee for the first amendment, however further amendments will be subject to an amendment fee of £30.
    c) Failed attendance or cancellation of a confirmed appointment within 48 hours of a scheduled appointment will be subject to the full outstanding balance of the chosen scan service package, less the cost of any additional souvenirs added, being debited from the card from which the deposit was paid.
    d) Amendments to a confirmed appointment within 48 hours of a scheduled appointment will be subject to an amendment fee of £30 being added to the outstanding balance, full payment of which must be paid at the time of amendment.
  16. Cancellation of the services by us: We may suspend or cancel the services if you do not pay us when you are supposed to or provide us with the information needed to carry out the services, or if in our operator’s professional opinion you display, or are suspected of displaying any of the exclusion criteria stated in section 6 above. We will refund you monies you have paid in advance if we have not provided the services but may deduct reasonable costs we incur as a result, including but not limited to the non-refundable deposit. In the instance of the agreement by ourselves to partially refund a bundle package consisting of multiple scans, the cost of any services/scans already provided, plus any additional reasonable costs incurred, including but not limited to the non-refundable deposit will be deducted from the total price you paid at that point in time.
  17. Delays outside our control. If we have to delay or amend the date or time of your appointment due to an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. This may be as a result of any technical issues, changes in law or regulatory requirements. Provided we do this we will not be liable for delays caused by the event. If there is a risk of substantial delay you may contact us to end the contract and we will refund you any money you have paid in advance if we have not provided the services but may deduct reasonable costs we incur as a result, including but not limited to the non-refundable deposit.
  18. Photography and Recording: Please note no personal photography or recording is allowed in the ultrasound studio.
  19. No Smoking or vaping: Smoking or vaping is strictly prohibited on or in the front of the premises.
  20. Links to other sites: We accept no responsibility whatsoever for linked websites or any information contained therein.
  21. Our Liability to You: We shall not be responsible or liable for any injury, loss or damage to personal belongings howsoever caused whilst you are on the premises. We are only liable for our failure to comply with these Conditions and accept responsibility for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable or not caused by us breaking the contract. We are not responsible for the breach of this contract caused by circumstances beyond our reasonable control. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew that it might happen, for example, if you discussed it with us during the consultation. We are not liable for any business losses as we only provide the services for domestic and private use. We will not be responsible or liable for any incidental or consequential loss or damage: 
    a) Caused by any act or omission by us or our employees or agents.
    b) Suffered by any person acting or failing to act as a result of the contents of any scan or any information supplied in connection with the scan. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. The below paragraph sets out your legal rights.
  22. No Professional Negligence Claims: You agree that you are purchasing our products solely for souvenir keepsake, non-medical purposes. You agree that you have no right to recourse against us in any medical malpractice, professional negligence, or any medical related claim arising out of or in any way related to your pregnancy or the birth of your child.
  23. Waiver and Release of Claims: You hereby waive, release, acquit and forever discharge Miracle View Ltd from any and all claims, expenses, demands, costs, causes of action, and other actions and liabilities, of any nature whatsoever, whether known or unknown, whether in law or equity, that you or your baby may have arising out of or in any way related to your visit to us. You agree that you shall have no right whatsoever to file any lawsuit or institute any other action or legal proceedings of any type arising out of or in any way related to your visit to us.
  24. Enforceability: This contract is governed by the laws of England and Wales and is the entire contract between you and Miracle View Ltd. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these Conditions operates separately.
  25. Complaints: We always strive to ensure our customers enjoy their experience. However, if you have any questions about the service or if you were unhappy with the service provided and wish to make a complaint, please contact us on the day of your appointment. We will do our best to resolve or rectify any issues you have. Alternatively, you can contact us by emailing your concerns to support@miracleview.co.uk. We will ensure your complaint is dealt with fairly and in a timely manner. We will try to respond to your email within 10 working days. If we fail to resolve your complaint to your satisfaction, then you can escalate it to a suitable arbitration facility. 
  26. Summary of your legal rights: This is a summary of your key legal rights. These are subject to certain exceptions. Your rights under the Consumer Rights Act: You can ask us to repeat or fix a service if it’s not carried out with reasonable care and skill, or get some money back if we can’t fix it. If your product is goods (i.e. any of our offered souvenirs), the Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality.
